Terms of Use.

These Terms of Use ("Terms") are an agreement between you and Wellspark Labs ("we", "us") governing your use of the SoulFuel mobile application and the soulfuelapp.com website (together, the "Service"). By creating an account or using SoulFuel, you agree to these Terms. If you don't agree, don't use the Service.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use SoulFuel on Apple devices you own or control, for your own personal, non-commercial use, subject to these Terms and Apple's App Store terms. We own the app; you own your journal.

2. Your account

You're responsible for your account and for keeping your sign-in credentials secure. You must be at least 13 years old to use SoulFuel. Provide accurate information, and tell us if you believe your account has been compromised.

3. Acceptable use

Don't misuse the Service. In particular, you agree not to:

• Copy, resell, redistribute, or publicly rebroadcast SoulFuel content at scale, or use it to build a competing product.
• Reverse engineer, decompile, or tamper with the app, or bypass subscription controls.
• Use the Service in a way that violates any law, or interferes with the Service or other users.
• Use automated tools to scrape, harvest, or extract content or data from the Service.

We may suspend or terminate accounts that break these rules.

4. Subscriptions

Parts of SoulFuel require a paid subscription. Current plans:

• Annual: $59.99 per year, with a 7-day free trial.
• Weekly: $4.99 per week.

How billing works:

• Subscriptions are billed through your Apple App Store account when you confirm the purchase — we never see your payment details.
• Subscriptions auto-renew at the end of each period unless cancelled at least 24 hours before the renewal date. Your Apple account is charged for renewal within 24 hours before the current period ends.
• If you start a free trial, any unused portion is forfeited when you purchase a subscription. If you don't cancel at least 24 hours before the trial ends, the annual subscription begins and your Apple account is charged.
• To cancel: open your device's Settings → your name → Subscriptions (or the App Store app → your profile → Subscriptions), select SoulFuel, and cancel. Deleting the app does not cancel a subscription.
• Refunds are handled by Apple under Apple's policies; request them through Apple, not us.
• Prices may change; we'll give notice as required, and changes apply from your next renewal.

5. Content disclaimer — not medical advice

Some SoulFuel content is generated with the help of AI. We work to keep it high quality, but we don't guarantee that any particular piece of content is accurate, complete, or right for your situation. You use the content at your own judgment.

6. Intellectual property

The Service — including the app, the SoulFuel name, logos, design, and all content we provide — is owned by Wellspark Labs or its licensors and is protected by intellectual-property laws. These Terms don't give you any right to our trademarks or branding. Content you create in the app (like journal entries) remains yours; you grant us the limited license needed to store and display it back to you as part of operating the Service.

7. Termination

You can stop using SoulFuel and delete your account at any time (Settings → Delete Account in the app). We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. On termination, your license ends; sections that by their nature should survive (including IP, disclaimers, and limitation of liability) survive.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELLSPARK LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR FIFTY U.S. DOLLARS ($50), WHICHEVER IS GREATER. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

10. Apple-specific terms

These Terms are between you and Wellspark Labs, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any product claims, third-party IP claims, or legal compliance related to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Changes to these Terms

We may update these Terms from time to time. If a change is material, we'll notify you in the app or by email before it takes effect. Continued use of the Service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of [State], without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in [State], and you consent to their jurisdiction.
